The SC Flip-Flopping and Its Implications On The People

Every day, when I read the news, I can say that I am somewhat knowledgeable of the major issues that creates clamor in the society. Take for example the “flip flopping” issue involving the highest court of the land, the Supreme Court.

As far as I know, the Supreme Court exists to make “final judgments”, where the lower courts cannot decide on, or if the verdict of the RTC’s and the Court of Appeals is being petitioned. At first, I just raised my shoulders when I heard issues like these, but lately, I find the flip-flopping (of the Supreme Court) somewhat boring but alarming at the same time. Alarming in the sense that if the Supreme Court cannot stand firm with their decisions or rulings that involves powerful people in the society, how much more if the case involves ordinary citizens like me?

Maybe if the “change in the final decision” was made once, I can understand, but knowing that it has been done for a couple of times, now it should be dealt with seriously. The Supreme Court should consider the implications of their flip flopping, especially to the residents involved; for instance, the residents of the Dinagat Islands in Mindanao.

For those who don’t know, in 2006 the RA 9355 otherwise known as “An Act Creating the Province of Dinagat Islands, was signed by then-President Gloria Macapagal-Arroyo. In Feb. 10, 2010 the Supreme Court made a ruling declaring that RA 9355 is unconstitutional, but then again later, on April 12, 2011 the SC decided to uphold the legality of Dinagat Islands provincehood. Because of this flip flopping, petitioners filed a motion on May 24, 2011 but sadly, “The Court Resolved to DENY WITH FINALITY the said motion for reconsideration as no substantial arguments were presented to warrant the reversal of the questioned resolution.”
